A parliamentary committee in Israel’s legislature has advanced a bill that would allow courts to impose the death penalty on Palestinian prisoners convicted of killing Israelis for “nationalistic” motives.
On Sunday, Sept. 28, the Knesset’s National Security Committee approved the proposal in a 4-1 preliminary vote. The bill, introduced by Limor Son Har-Melech of the far-right Otzma Yehudit party, seeks to execute Palestinians accused of murder motivated by “racism or hostility toward the Jewish people” Ironically, its provisions do not apply to Israeli settlers who kill Palestinians under comparable circumstances.
Israeli National Security Minister Itamar Ben-Gvir, leader of Otzma Yehudit, spearheaded the proposal. He insisted that capital punishment would serve as a deterrent against Palestinian resistance. “They need to know that if even a single hair of a hostage falls, there will be a death sentence,” declared Ben-Gvir, who oversees Israel’s prison system. The bill’s passage came amid concerns from Prime Minister Benjamin Netanyahu’s office and hostage negotiators, who warned that it could endanger Israeli hostages held by Hamas and escalate already brutal conditions for Palestinian detainees. Families of Israeli captives likewise warned that such rhetoric only endangers their loved ones. “Survivors of captivity clearly told us that every media stunt about the death penalty leads to harsher conditions and violence against the hostages,” wrote Lishay Miran Lavi, whose husband remains imprisoned in Gaza.
Critics argue the legislation is part of a broader system of repression that has long targeted Palestinians – citing reports of torture, starvation and sexual assault in Israeli prisons. At least 76 Palestinian detainees have died in custody over the past two years, though rights groups fear the true toll is far higher.
Legal experts also challenged the bill’s validity, noting that the committee vote occurred during a Knesset recess without proper consultation with security officials. This procedural breach, they pointed out, could invalidate the decision.
Meanwhile, Palestinian prisoner advocacy groups condemned the measure as “unprecedented savagery” and an attempt to “legalize the ongoing killing of detainees.” They pointed to Israel’s decades-long record of systemic abuse – including electric shocks, waterboarding and sexual violence – documented by the United Nations.

With Gaza’s death toll surpassing 66,000 and thousands of Palestinians languishing in Israeli prisons without trial, critics warn the legislation risks further entrenching apartheid and fueling cycles of violence. As international scrutiny grows, the question remains whether Israel’s government will prioritize punitive measures over accountability.
